PRELIMINARY CLAUSE – WHO ARE WE?
Asociación Nacional de Fabricantes de Zumos y Gazpachos – Zumos y Gazpachos de España – is the business organisation that brings together the main producers of juices and gazpachos in our country and represents them in all areas, and before public administrations and private entities of all kinds.
Established as a business association in 1978 under the name ASOZUMOS, the Association includes both industries dedicated exclusively to the marketing or packaging of juices and gazpachos, as well as those engaged in the processing of raw materials and the production of semi-processed vegetable products, and key companies in our value chain, covering diverse business models.
With an extensive catalogue of products offered by our companies: fruit or vegetable juice, fruit nectar, beverages with a high fruit content, gazpachos, salmorejos… All of them share a common denominator: enhancing the value of the richness and quality of Spain’s fruit and vegetables, which places companies in the sector in an excellent starting position when manufacturing these products.
Zumos y Gazpachos de España is a member of FIAB and AIJN.
1. TERMS AND CONDITIONS
These Terms and Conditions govern the use of the Internet portal service “https://www.zumosygazpachos.com/es/” and its subdomains (hereinafter together, the “Portal”) which Zumos y Gazpachos de España makes available to Internet users. These Terms and Conditions (which may be amended from time to time by Zumos y Gazpachos de España) apply to all services available online, via any electronic device, mobile device, by email or by telephone.
By accessing, browsing and using our Portal and/or creating an account and/or accessing the “Members’ Area” on the Portal, you acknowledge that you have read, understood and agree to these Terms and Conditions (including the section relating to privacy). Use of the Portal confers the status of Portal user (hereinafter, the “User”) and implies full and unreserved acceptance of each and every provision contained in these Terms and Conditions in the version published by Zumos y Gazpachos de España at the time the User accesses the Portal. Accordingly, the User must read these Terms and Conditions each time they intend to use the Portal, as both the Portal itself and these Terms and Conditions may be amended by Zumos y Gazpachos de España.
These pages, their content, structure, infrastructure and the information provided through this Portal (the “Service” or “Services”) belong to, are managed and supplied by Zumos y Gazpachos de España, and may only be used for personal and non-commercial purposes, in accordance with these Terms and Conditions.

By uploading photographs or other images to our system, you certify, warrant and confirm that you hold the copyright to the image and agree that Zumos y Gazpachos de España may use such image on its Portal, websites and promotional materials (online and offline), as well as in any publication it deems appropriate.
You grant Zumos y Gazpachos de España a non-exclusive, worldwide, irrevocable, unconditional and perpetual right and licence to use, reproduce, display, reproduce, distribute, sublicense, communicate and make available such images in any manner deemed appropriate. Zumos y Gazpachos de España disclaims any liability or obligation in relation to the photographs published. The natural or legal person who uploaded the photos guarantees that the photos/images do not contain any virus, trojan or infected files, nor any pornographic, unlawful, obscene, offensive, objectionable or inappropriate material, and that they do not infringe third-party rights (intellectual property, copyright or privacy). Any photo/image uploaded by a User that does not comply with the above requirements will not be published and/or may be removed by Zumos y Gazpachos de España at any time without prior notice.
3.3. Intellectual property rights
Unless otherwise stated, the software required for our services or used on our Portal and the intellectual property rights (including copyright) in the content and information, as well as the material on our Portal, belong to Zumos y Gazpachos de España.
Zumos y Gazpachos de España exclusively reserves ownership of all rights, title and interest in all intellectual property rights in the Portal (including the infrastructure) through which the service is made available, and you have no right to copy, collect, link to, publish, promote, sell, integrate, use, combine or otherwise use the content or our brand without written permission from Zumos y Gazpachos de España.
To the extent that you wish to use (in whole or in part) our content or you own any intellectual property rights in our Portal or any content, you hereby transfer and assign all intellectual property rights to Zumos y Gazpachos de España.

5. GOVERNING LAW
5.1. Applicable law
These Terms and Conditions and the other legal terms of the Portal shall be governed in each and every respect by Spanish law, in particular the Law on Information Society Services and Electronic Commerce (Law 34/2002 of 11 July) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
5.2. Miscellaneous
Any dispute arising from these Terms and Conditions and the Services and products offered by Zumos y Gazpachos de España shall, at the consumer’s discretion, be submitted exclusively to: (i) the competent courts of the place of the consumer’s domicile; or (ii) the competent courts of Madrid (capital), Kingdom of Spain.
For all other parties using the Portal who are not consumers, these Terms and Conditions and the services provided by companies affiliated with Zumos y Gazpachos de España shall be governed and construed exclusively in accordance with the legislation in force in the Kingdom of Spain, and any dispute arising from these Terms and Conditions and the services provided by Zumos y Gazpachos de España shall be submitted exclusively to the competent courts of Madrid (capital), Kingdom of Spain.
If any provision of these Terms and Conditions is or becomes invalid or non-binding, you shall remain bound by the remaining provisions. If this occurs, the invalid provision shall be complied with to the maximum extent permitted by the applicable law and, to the extent possible, an effect similar to that of the invalid or non-binding provision shall be accepted, in accordance with the content and purpose of these Terms and Conditions.
